These Terms of Service ("Terms") govern your use of the XPSLab web application at app.xpslab.com, operated by XPSLab ("we", "our", "us"). By using XPSLab, you agree to these Terms.
You must create an account to use XPSLab. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when creating your account.
You agree to use XPSLab only for lawful purposes. You may not:
You retain ownership of all data you upload or create in XPSLab, including XPS spectra, fitting results, and project files. We do not claim any intellectual property rights over your data. You grant us a limited license to store, process, and display your data solely to provide the service to you.
We strive to keep XPSLab available at all times, but we do not guarantee uninterrupted or error-free service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify users of planned downtime.
While we take measures to protect your data, we recommend that you maintain your own backups. We are not liable for any loss of data. You may export your projects at any time using the built-in export features.
You may delete your account at any time from the Account settings page. Upon deletion, all your data will be permanently removed from our servers. We reserve the right to suspend or terminate accounts that violate these Terms.
XPSLab is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will meet your specific requirements or that analysis results will be accurate for any particular application. You are responsible for verifying the correctness of any scientific results produced by the application.
To the maximum extent permitted by law, XPSLab and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from reliance on analysis results produced by the service.
We may update these Terms from time to time. Continued use of XPSLab after changes constitutes acceptance of the updated Terms. We will notify users of material changes by posting the updated Terms on this page with a revised effective date.
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
